Most people probably don’t know the names Brian and Cindy Jensen – unless they rent out property in the Sunapee area. And many of those landlords know those names better than they’d like.
The couple owe prior landlords more than $35,000 in back rent, and the IRS is due nearly $185,000 in unpaid taxes from Brian Jensen, according to court records. They couple is charged with passing bad checks and breaking into a Bradford home last year, living there for weeks rent-free.
And Brian Jensen’s repeated efforts to seek bankruptcy relief of his more than $195,000 in debt led one bankruptcy lawyer to accuse Jensen of a “pattern of bad faith.”
Given all that, 30-year-old Jason Cross of Sutton said last week he’s accepted he’ll never see the more than $3,000 in unpaid rent a judge ordered the couple to pay him last year. What Cross can’t understand is how the Jensens have stayed one step ahead of real consequences for so long.
“I’m not saying tenants shouldn’t have rights, because they absolutely should,” Cross said. “But to the extent that Brian and Cindy can do this to people under the law is ridiculous.”
Rental to rentalFor the last three years, Brian, 50, and Cindy, 45, and their four children have moved from rental to rental after being repeatedly evicted for failing to pay rent, according to court records. And while the family has stayed within the New London, Bradford and Sutton area, they’ve always found a new landlord unaware of their record and willing to rent to them.
Since 2008, at least four of the couple’s landlords have taken one or both of the Jensens to court and been awarded more than $35,000 in back rent. Another former landlord has filed a claim for back rent in Brian Jensen’s pending bankruptcy case.
But despite winning their lawsuits, the landlords have been unable to collect their money because Brian Jensen has followed each loss in district court with bankruptcy filing in federal court. And while Jensen has repeatedly been denied bankruptcy relief, his filings alone have been enough to freeze the civil cases in district court.
Cindy Jensen filed her own bankruptcy case in 2006, claiming $56,000 in debt and was cleared of that debt.
Brian Jensen is pursuing his fifth bankruptcy petition in six years, but he’d only filed three when a court lawyer accused him in 2006 of using the filings as a tactic. “It appears that each (petition for relief) was merely filed to delay and frustrate his creditors,” Lawrence Simski wrote.
And the government trustee overseeing Brian Jensen’s pending bankruptcy plea has accused him of lying about his assets. Missing from Brian Jensen’s financial statement were four all-terrain vehicles worth $20,000, among other things, according to court records in the case.
Facing allegations of perjury and another denial of financial relief, Brian Jensen responded to the bankruptcy court in writing last week. He blamed the errors in his filing on the two attorneys who once worked on his case, although he signed the filings, confirming the material was accurate.
Matthew Conway is watching that bankruptcy case closely.
Conway, who lives out of state, is waiting on nearly $25,000 the Jensens have been court-ordered to pay him for a New London building Brian Jensen began renting in 2007 for his business. Conway passes the latest updates in the case onto Cross and the Jensens’ other former landlords, several of whom have connected through their court cases.
“The No. 1 emotion I think for all of us is first anger,” Conway said
